Divorce and Citizenship

My Sister came here in US on Fiancee visa in 1999 and got married within 90 days per law .
Her Ex husband came to US when he was a child . He is a US Citizen.
She got married to him in August 10th 1999 .. They had a baby in July 2001 . Because of issues with his parents they got separated in October 2001 and She filed for divorce in November 2001 . They got a divorce on August 16th 2002 ( They were married from August 10th 1999- August 16th 2002... so only a few days over 3 years)
She got her Conditional Green card in Sept 4th 2001 (which should have been unconditional to begin with as 2 years of marriage were complete on August 10th 2001..it was later changed to unconditional Green Card in April 2002).. So she has Green card since Sept 2001. As She was married for a period over 3 years to a US Citizen and has Green Card since Sept 2001 .. Will she be able to apply for her Citizenship in Sept 2004 (after 3 years of Permanent Residence or will she have to wait till completion of 5 years of Permanent Residence)

if you want a GC..sometimes you have to put up with priks to get the job done!
consult a lawyer!

As long as no misstatements or misrepresentations were made in either the i-485 or i-751 applications, I see no problems, she will, however, need to wait for 5 years for citizenship.
