Divorce after sponsorship........

I got married on 2001 outside US. filed for I-130 on 2003. He got here in US January2005. I falls out of love. We both wants divorce. But im worried it would have a big problem regarding his status. He got his green card (unconditional).would he get deported? Would i go to jail if we gets the divorce? But our marriage was real. We were really inlove when we got married and last for almost 4 yrs.
what would happen if we file for divorce? Im a US citizen though.
PLEASE HELP before i file for divorce.

Please get your husband to spring the $250 and talk to a reputable immigration attorney about this. I assume you want your husband no harm other than that you guys want to part ways.

I recently discussed a very similar issue with an immigration attorney, and this is what he told me: As long as you guys intended to remain married the day he became a permanent resident, you can file for divorce any time thereafter. I assume he got his permanent greencard (unconditional) once he entered the country because you guys were marrried for more than 2 years.

He should just keep documentation that you took up a domicile together, had common bank accounts and filed your taxes together (might not apply in your case). So, 5 years from now at the citizenship interview he can show that he came while beeing in a good-faith genuine marriage (which broke apart at a later point). The only time the USCIS gets nasty is if people think that the goverment workers are idiots.

But be sure to check with an attorney, this is just hearsay and my interpretation based on a slightly diffferent case.
