My wife and I have been married for over 2 years. I am a US citizen, she will get her unconditional green card soon (status page shows that the card production had been ordered for her). Things haven't been working that good, so we want to divorce.
The first question is: when can we file for divorce? Despite divorce, we are going to stay friends and I don't want any trouble for her with USCIS. Should we wait for two years after "Residence since" date on her green card?
We would like to do a summary dissolution of marriage (that is a simpler divorce, without having to appear at a court). We don't have any disagreements on division of property (we don't have that much). However, to qualify for summary dissolution the couple must not have incurred more that 5K debt. She just got a school loan for graduate studies for about 20K.
The second question is: is it OK to mention on divorce papers that we separated, say, this August? This way we don't have to mention this loan. But again, would it cause any trouble with USCIS?
We plan to do all divorce papers ourselves, getting a lawyer is an option, but so far we don't see any real need for that.
