Hey Guys, I need your help....

I just got got my conditional permanent resident status. I have been married to my USC spouse for a little over a year. We got Married in Nov 2004. I am now considering divorce because of a wide array of personal problems but mainly due to infedility and drug addiction on part of my spouse. I had suspected her being unfaithful for a few months but never believed it. Now I have seen it with my own eyes. Hence, our marriage is over atleast as far as I am concerned. We haven't tried counselling yet but as far as I am concerned no counselling will help me get over this trauma that has been inflicted on me by my wife.

Anyway, I am not looking to get pitty here but some advise. Hopefully, one of you can give me some information that will be helpful in my case.

What I would like to know from you experienced people here is if I get divorced and apply for the condition to be removed from my permanent residency what are my chances? I know I have to proove that the marriage was bonafied and not a sham. Has anyone posting to this board or reading this message has had any experience in filling for the GC removal of conditions after divorce. If so can you please guide me as to what I should do. I can hire a good attorney but before I do this I need to know what my chances are of getting the condition removed if we get divorced.

Please, some one listen to this outcry and help me with some useful information.

Thanks for your help

First of all, you should strongly consider getting a lawyer. Secondly, if there are any police reports against your spouse regarding drugs or if you can prove infedility, your case will be much easier. To sum it up, the proof of burden is on you. Unless you can prove that the marriage was bonafied, USCIS will listen to the USC and not you.

Good Luck
