My marriage is having problems. I am a US citizen living in Maryland, USA. My wife has a conditional Green Card ( received 4 months ago). If I divorce in USA, will she still have the conditional Green Card? If I divorce in India, will she still have the conditional Green Card? Am I liable for her alimony after divorce in USA ? Am I liable for her alimony after divorce in India? I would appreciate a response.

Do not divorce .........

If you want to help her even taugh you having big problems in your relationship please do not make her suffer that way especially if she has a conditional GC . If you divorce during her conditional status after two years the immigration will deny a request for change of conditional GC to the one of permanent because the mariage has to last at least two years before she can proove that it was a bonafid one . Before the two years a divorce would automaticaly end her residency status and will be subject to deportation ......Try to work out the relationship that is always a good thing .......better for her .

The spouse will lose the GC regardless of where you divorce, as Philaug mentioned. I cannot tell you what to do, but I can only wish things turn out ok.

I just hope your intentions are honorable, as it seems to sound like you're looking for an easy way out with the divorce and the alimony. The alimony part is not something for this forum or even this board to answer, so I've not answered that.

Sorry for my suspicion, but what you asked about was the exact same thing a slimeball co-worker did, and it's really horrible to do that to someone, even if you don't get along.
