I am in the beginnings of N 400 application, and have been A permanent resident for almost 9 years. In 2011 I was arrested for domestic dispute with former wife (12 hours in jail). Charges were dismissed completely and I had my record expunged. The problem is that I had my brief case go missing recently and both records were in it. I can not get any records from county court because it has been expunged, so I have nothing but a "disclaimer" from county court that says I have no record. What to do???

If you hired an attorney you might want to contact them to see if they have copies of documents from the court. Also, you might want to contact the law enforcement agency that handled your arrest to see if they have any records regarding the matter.

Yes checked with lawyer and they had nothing that showed it was dismissed, also checking now with sheriff dept but they do not think they will have any thing either since it was expunged and the county court shares the same system they do, and nothing was found there. Thanks for the response and any other suggestions would be greatly appreciated.

Hi,

I hope this might help you.

I got my certified court disposition on traffic citation at the court house. The court clerk is very helpful. I just provided her my driver license number. I need to pay $25 to get the printout certified.

By the way, I am in Los Angeles.

You might want to call the court house and speak to the clerk. I believe the court house will be able to provide the court disposition document on your domestic dispute charges. Remember to ask about the charges. Nothing is free nowadays..lol

All the best!

still need help

Asked the court for the disposition as well and they still told me that since it was expunged they have nothing. I don't get it. If they know I was arrested, they must know it was dismissed. How can I be refused Citizenship when the charges were completely dropped? I am stressed and going to see my immigration lawyer on the 13th (she did my green card) so hopefully she has an answer, and if she does I will share it. Any other suggestions are welcomed, and thank you in advance.

This might sound odd but you might want to verify the court in which you are attempting to get the information from had jurisdiction for the charge at the point in which the charges where dropped. Without knowing what state you live in I don't know what court system you have.

Thanks, yes I have the right court and they are adamant that since it was expunged they have nothing. I am in Tennessee where they do not have a lot of experience with immigration matters. Someone at the county building was very surprised when they found out that Canadians were in fact not citizens already. LOL. Thanks for your advice.

According to M-477, which is the checklist of documents needed for a N-400 application, it states if you ever have any arrest expunged or otherwise removed from your record to send an original or court-certified copy of the court order or an original statement from the court that no record exists of your arrest or conviction. The information is halfway down the page on the second page. When they say original it means they want you to send the actual piece of paper that you get from the court with your N-400 paperwork.

If you want more information about what documents to send then you can access the M-477 here (page 1 and 2 of the document): http://www.uscis.gov/files/article/attachments.pdf
