Discrepancy in DS 230 part 1

My attorney just found out that there is a discrepancy in the item 22 and 25 of form DS 230 part1.

Issue 1: In item 22, my position had changed since I joined my company. But the DS 230 part 1 form submitted to NVC has only the latest position. I have made the appropriate changes and will take the corrected DS 230 part 1 with me to the interview. Does anybody think, this could be a cause of concern?

Issue 2: In item 25, there is a similar discrepancy. I have been in the same city for last 4 years, but I went to India for about 20 days. Do I need explicitly show that I was out for 20 days?

In short, will there be a problem/issue, if I submit the corrected DS 230 Part 1 during the CP interview? Or should I send the corrected DS 230 part 1, in advance of my interview at the US consulate?

I had a similar problem with my labor & Ds-230 part 1.


Since I filed my labor the name of my position changed , same responsibilities but different name - What I did is put the new name of position on DS-230 and within parenthesis mention old name i.e

XXXXX (yyyyyy)


I don't know if I will face problem at CP interview

My 2 cents - The employment letter you get - u can have name of new position as well as old position in parenthesis basically saying both are same and havve same responsibilities.

You know, I am not speaking out of any personal experience, but here are my thoughts on this:

Item 22: This is not an issue, since you would be ready to
submit the corrected DS 230 Part I at the Consualte.

Item 25: My attorney made me enter all the entries and exits to and from US. I went on vacation in the month of May 02 for 25 days and I have entered the actual dates of re-entry.

But this will not be an issue at the Consulate, since you can file
the corrected sheet.

If I remember correctly somebody posted that the Consular officer has specifically asked whether there are any changes in the
information.

Bottom line is , this is not a problem at all. You are safe!

Thanks for the quick replies. There is a good sense of relief when our thoughts are in sync with others in situations like this. This is the biggest advantage of forums like this, that we all can share experience and learn for each other mistakes.

1. In my form the lawyer had put the same name for mine and my wife's mother. I corrected this when we submitted the form at the interview. Nobody even asked us about the change.
2. My position too had changed from the time of filing, meaning it was different from the one sent to NVC. The employer letter mentioned the new designation and additional repsonsibilities. There was no problem.

I also think there is not going to be any problem with your case. But I would suggest is to frame your Employment letter appropriately...

Like...

Mr. CpDelhi has been working for DelhiUS LLP from so and so date. CpDelhi joined the company as a XXXXX with a salary of $70,000 plus other benefits. He had following responsibilities....

In so and so year CpDelhi was promoted to YYYYYYY now drawing a salary of $75,000. Apart of above mentioned responsiblities, Cpdelhi is now also responsible for following .....................................

Please assist CpDelhi in granting the Permanant residence and Cpdelhi would have a permanant position with us when he returns.

Thanks for the example employment letter. I will try to get the wordings of the letter in similar fromat.

Q1. Does the consular officer really go through the employment letter and its contents? Or its just another formality/paperwork?

Just a formailty paper work.... But this format would be a nice place for your explanation to Designation change.... That is if asked for..... The chances of which are minimal but cannot be ruled out.

Employment letter

Though it seems like a formality, there are some ground rules
and the consular officer looks specifically for few points like,

Assurance of a continued job.

Confirmation that the position mentioned in the LC is still waiting
for the candidate.

Assurance on payment of the salary mentioned in the LC.

There are also severe legal implications to the employer
for any defaults ( if any one goes that far..)
