Good morning all,

My son's petition for an I 130 was denied, because he applied a month shy of his 21 year birthday. It is the only reason why it was denied. We plan to resubmit it again. Since it took us a year to receive the denial letter, can we submit at the same time the following forms to " speed up" the process ?

- I-130 Petition for Alien relative
- I-485 Adjustment of Status
- I-765 Work Permit
- I-912 Request for fee waiver ( since all these fees would be a burden on us)

Please note that my son is obviously a US citizen ans I am currently in the US . Any insights or constructive suggestions would be greatly appreciated.

Regards,

Yes, I-130, I-485, I-765 (for EAD), and I-131 (for Advance Parole) can be filed together. I-765 and I-131 are free for I-485 applicants.

You entered the US legally, right?

Thank you for the prompt response. Yes, I entered legally. Why would I need the I 131 and what is it for ? Thanks again. Much appreciated.

Advance Parole, once granted, allows you to leave and re-enter the US while your I-485 is pending and your I-485 won't be abandoned.

I believe you listed your son as petitioner. It should be other way out. Your son should be beneficiary and you as petitioner.
