Dilemma!!!! Appreciate your input

Hi Everybody,

I’m a JAN-2002 filer and just been through FP2, about a month ago. My H1-B is about to expire, in four weeks time.

Questions:

1. Should I renew my H1-B and pay hefty lawyer’s fee OR start working on EAD :confused:

2. If I-485 denied, for some out of this world reasons? Will I be able to continue working on H1-B, if renewed for another three years :confused:

I would say renew your H-1B. It is always good to be on H-1. Your travel out of the country is very easy. But apply for EAD too, just in case you are laid off and you can find a job easily using AC-21. Why do you want to hire a lawyer and pay the fee? Instead do them yourself. This forum gives you all the info.
 
I have seen my friend's case in which he had H1B then he got a EAD to work on with the same employer.Then it was the start of the new EAD processor need to wait for EAD in mail.somehow he forgot to renew his EAD.Then He got a new H1B(Permium process)from the same employer and worked in EAD.But not sure what happens If 485 rejected ???....
 
I would not take any risk at this last stage...
Please Go ahead & renew H1B.....

I am one of the Dec'01 filers and have done 2nd FP and already completed 11 weeks after 2nd FP.......With time this delay will be more & more, I think.

I would say go ahead and renew your h1b. Based on your Job security take a decision on applying EAD.

I've contacted my lawyer and in the process of renewing my H1.

BTW: I already have EAD but never used it.
