I am in my 6th year of H1 (6 years expiring in Oct 2007), my labor is approved and my I-140 is still pending. There is a strong possibility that I may be laid off soon. I am trying to know what my options are,
1> Can I change employers at this point of time?
2> I have about 6 and half months of vacation time which I can claim on my H1. Will this be of any help if I transfer my H1 to a new employer?
3> It may be very difficult for me to get a copy of my approved labor from my current employer, will it still be possible for me to start my GC process through a new employer?
My situation is very difficult and I need help from immigration Gurus ASAP.
