Different followup answers from Senator's and Congressman's office

Guys,

Here is my situation. My I-485 ( EB-2) has been pending with NSC since Feb 2003 and currently they are working on Nov 2003 cases. When I followed up with my state's Senator's office, I got a letter from NSC saying that I am under EB3 category and visa numbers are currently unavilable.
When I told the senator's office that this is not correct and my case is under Eb2 category for which the VISA numbers are currently available they followed up again with NSC. Now the senator's office is saying that they are currently reviewing my case to decide whether it is under EB2 or EB3 category. when it was almost more than 4 weeks I thought of following up with the congressman's office. They are are saying that my case is pending due to Security check. I got an email from fbinncp that my name check results were sent to the washington DC office way back in March 2003.
When I told this to the congressman's office they asked me to forward me that email which I did today.


Please suggest me what are my options now. Should I write a letter to NSC directly?

yeah, I got same situation, every time, you heard a different story, but they will use the name check as their last excuse. Try ask your senator to commnuicate with FBI, to see if it is really caused by name check.

NSC cannot be trusted on the case status. I believe FBI's email (that your name check was completed March 2003) is more trustworthy.

Best solution is to ask your congressman to contact FBI congressional liason, and they can get answer within 1 week. This way, you will know for sure whether your name check is really pending, or was completed already. If still pending, there is not much you or congressman can do; if completed, ask him to follow up with USCIS with FBI confirmation.

USCIS is a liar. My status inquiry experience with them is that, I've made 3 inquiries through 3 different channels, and got 3 different answers. The forth time, my employer asked a different congressman and asked FBI directly, got a totally different answer!

Those 4 inquiries were all performed within 30 days:
1st time: attorney inquiry from USCIS "...under preliminary screening..."
2nd time: senator inquriy from USCIS "...pending under security name check"
3rd time: my congressman, from USCIS "name check pending since Sep 2003"
4th time: employer congressman, From FBI: "name check pending since 3/11/2003".

When you ask a person the same question 3 times, and each time get different answer, would you agree that this person is a liar?
