What I got extract from different attorneys and forums that we can file claim for back pay by using either of the following form -
1) State Govt. Division of Labor Standards Enforcement (DLSE) form
2) WH-4 form from DOL
My questions are -
1> What is the difference between two forms? Which option is better?
2> If my employer will terminate my job how long I can stay in this country to search a new job? Will I be deported immediately after layoff?
3> Will I loose right to get back pay if I am deported to my home country?
