Trying to get a sense of how many people are in this boat. Can anyone suggest, what the best way to gauge how many people
a) Already applied
b) Planning to apply
for I-485????

revised visa bulletin??????????

I was getting ready to file 485. This morning I got an email from my lawyer saying we cannot proceed until October.
Where is the revised bulletin for July 07. Accoring to citizen & immigration services there statement reads:
July 2, 2007, 12:10 PM EDT - Dept. of State has revised its July Visa Bulletin to reflect that all available employment-based immigrant visas have been allocated for fiscal year 2007.

As a result, beginning today, USCIS is rejecting applications to adjust status (I-485) filed by aliens whose priority dates are not current under the revised July Bulletin.
So my ?? is, who's priority date is current under revised bulletin. I can't find this bulletin. Anybody else had luck finding it????

I was all set to file but got emailed from my ATTY about the revised bulletin.

My ATTY says I should still file because of the benifits (if any) possible with the lawsuit.

I am not sure thats the route to go, simply because of the cost involved (pay filinf fees 2ce, additional ATTY fees) and that nobody knows how much chance this lawsuit has to suceed...

Also, if ur a Plaintiff, USCIS may scrutinize ur application minutely (from what I read on murthy forum).

I am in a real dilemma what to do...

Yes, cost is big factor in the decision to file. Check with lawyer, if he would charge him again the next time you are eligible to apply. or you can have all the documentation so that you could file it yourself next time.

Regarding being a plaintiff, you can choose not to be one. Moreover, lawsuit is being filed and they already have the plaintiffs. You can just apply, get the reject notice and keep it. If lawsuit is won, you can reap the benefits. If not, you will have to apply when your date is current.

PD Current in June I-485 mailed July 2nd

Our PD was current on June but due to our lawyers incompetence we we'rent able to file it until July 2nd. USCIS received it on the 3rd of July.
 
What about World wide category. Are the visa numbers not available for this category too. I was hoping to file for 140/485/ead/ap before oct as i have travel plans then.ANy inputs.

My package was sent on 7/5 and received on 7/6 - My Attorney wants to see if they send a rejection notice or send the package back.

Mine was sent on June 29th. Received confirmation from FedEx that it was delivered/reached NSC on July 2nd. :-(
 
Lawyer said she mailed the package on Friday June 29th but hasn't provided the tracking number. I'm assuming it got there July 2nd.
 
Was applying in July - medical appointment next week

Hi guys, I have a pending I-140 and was one of the people who to my amazement my category (EB3-rest of world) suddenly became current, having completed all the paperwork and just waiting for the medical I was upset to see the revised July bulletin. Can anyone help me with two question? if I carrry on with my medical is it still valid in October? The revised bulleting says that "All numbers available to these categories under the FY-2007 annual numerical limitation have been made available" - does that mean that EB3-rest of world will become current again for the October bulletin and I should be ready for my application to be received at USCIS on 1st October??? Thanks!!

I am fairly close (may be the legal has the approval and is not keen on letting me know about it...) to having the labor cert approved. Now, if we go ahead and apply for I140 (only), and wait till October. And if in October am eligible to file for 485.... can I do so while my I140 is still pending. Lawyer and company are do not want to apply the 140 in premium processing.

You surely can apply for 140. When you are applying for 485, the receipt notice of the pending 140 would suffice. Make a note that 140 premium processing is history. Premium processing for 140 has been suspended as of July 2nd.

Has anobody seen a thread or can you shed some light regarding the pros and cons (other than the $1K) of filing premium processing now that it is going to be available again? I filed concurrently in June 2007 (see signature info) and one of my attorneys told me I can file PP but the other one advised not to waste my money since I still have time on my H1B so I didn't.. It is possible that if I have filed PP in mid-June, I probably would have had my I-140 approved by now instead of being stuck in that huge mess created by immigration the past few days..but that's all history and impossible to change. Going forward, given that EB2 is also closed now, would I be in a better position if I get the I140 approved before the day they open EB2 again or would it make no difference? Would PP help get EAD and AP faster? Thanks.
 
QUESTION for experts! Please reply!

I am waiting for my blood tests to come back from the doctor. When I receive my sealed packet from him, I will be ready to file my I-485.

I want to file before July 30th to avoid the increase in fees.

Question: If I file now, will it be rejected and will I have to refile again on October 1st with the increased fee, anyway?

I am EB3 rest of the world (Canada).

Yes you can send the package and most likely they will send the package back to you and when the PD becomes current you have to pay whatever the new processing fees. Hope this helps.

Now I have question about H1 extension. My company applied for H1 extension in Mar22nd, 07 and it still shows "case received and pending" - in CSC service center. How long did your's take?
