Did The Law Changed? Please Clarify

the are rumors flying all overthe place that the INS are approving asylee greencards from the date you get asylum, if this true, this will be a great news,


i wish somebody can step forward an tell us whats going on,

there are a lot of people on this forum who are ND 2000, AND ND 2001,who got green card recently backdated one year, we will be glad to see the law changed.

ND : FEB 2001
FP : MAY 2004
BIO : AUG 2005
APPROVED : AUG 16 2005
BACKDATED ONE YEAR ONLY
CITIZENSHIP : MAY 17 2009

IF THE LAW CHANGED, I WILL APPLY FOR CITIZENSHIP TOMMORROW MORNING
 
John Smith: I don't think there is a change in the immigration Laws. I think the only case we have seen so far is a mistake by the adjudicating officer. If there were a change in the laws we would have seen it all over the media. And the provision that governs the backdating of asylum applications states, "5) is admissible (except as otherwise provided under subsection (c)) as an immigrant under this Act at the time of examination for adjustment of such alien. Upon approval of an application under this subsection, the 3/ Secretary of Homeland Security or the Attorney General shall establish a record of the alien's admission for lawful permanent residence as of the date one year before the date of the approval of the application."

For those whose case was backdated from the date of grant of asylum. Enjoy it....

as you stated in your time line that your case was transfered back to asylum
office ,we are also in same situation , my wife aplied for 485 in 2005 and she got her bio in march of this year ,now we got weird message stating that her case is being transfered to sfo asylum office for further processing ,so far we did 'nt get anything from sfo asylum office.now we live in newyork.please
share your experience in sfo office,like what kind questions etc.

His situation was different from yours. He needed to complete the nunc pro tunc processing which is just an annoying formality.

What you are facing is more uncertain and precarious.
 
It may not be completely true that the law has to change and that it would be all over the place (media, websites etc). Sometimes USCIS could issue so-called 'memo' (unfortunately most of the time - internal memo) and continue processing.

You are right. My case was nunc pro tunc, and I already got my greencard. It was just a formality....
