Hi , I had come here on H1B in Oct'98 and then went back in Feb 2000.

I again came on a fresh H1B in July 2001 of and then got it transferred to L2 VISA in Jan 2002.I went to home country in Dec 2002.

I re-entered US on H4 visa in Nov 2003 after 11 months in home country.

I got new H1B in March 2004.

Will my 6 yrs get counted from March of 2004 ? (Current H1B).

Or July 2001 ?. (2nd H1B)

OR Oct 1998 ?.(1st H1 Date - 1st time in US.)

Hi Jim, since the 2nd H1B period was only from July 2001 to Jan 2002 (5 months) , the rest was either L2 (11 months), outside US (11 months) and H4 (2 months) , does this be counted was stay outside of H1B together.

How come the period of L2 be couted with H1B as might be aware that for folks entering on L1B and seeking H1B , their period starts with H1B and not the date of entry of L1B.

All time in H and L status counts toward the six year limit.
 
hi jim,

I am currently on H1B and completing my 6 Years in Jan 2006. Can I be on H4(since my wife can get H1B ) after completing 6 years

No. As I stated above, ALL time in H or L status counts. Time in H-4 status is time in H status.
 
and EAD

My wife was on H4 for last three years. Now she is on EAD for last one year.
She is applying for H1B.

SHe will get on H1B now 3 more years(excluding EAD's one year) or 2 Years.
