But neither our lawyer/employer have received the approval notice. i tried calling the National Customer Service Center, but it has the same recorded message saying "your case has been approved...blah..blah"..Dont know what to do. Who else can I contact to find out about it. Please any advice is welcome..

Sometimes it does takes 3 weeks and all these holidays in between.

I received my AP on the 24 th day after approval

jdr,

I'm in the same boat. My I-140 was approved on 12/13/2004. My laywer said he hasn't got the notice yet yesterday. So far I haven't heard any of my I-485 news yet.

Here is my info:
______________________________________
PD: 5/6/2002 (Labor EB2, I-140 filed as EB2 but got EB3 notice, but my lawyer filed correction letter, not sure whether this will help. But anyway I'm not in the backlog timeframe)
I140/I485 ND: 03/30/2004
FP: 10/23/2004
I140 AP - 12/13/2004
I485 - ?????

NoPatient, my I140 was approved on the same date as yours and my employer got the approval notice on the following week.

Here is email I got from my lawyer "As of December 28, 2004, CIS rescinded its memo regarding concurrent adjudications. Therefore, cases will no longer be adjudicated concurrently. Therefore, for I-485 processing, you should refer to official TSC processing time of 7/2002".

jdr, pinoy69, let's keep on updating this thread to see how's going with our cases.

Last update on my case

Got an email late yesterday from USCIS acknowledging my attorney's response to RFE. I'm praying that they will continue processing my case though my PD is after Jan. 2002.

My company got the courtesy copy but my lawyer didn't because the approval notice only listed my lawyer's name not his address.

Unfortunately my I-140 approval notice still shows I'm in EB-3, looks like my lawyer's previous correction didn't work. He is going to file another correction to correct my I-140, because right now EB-3 has backlog, this puts me in a bad situation.

NoPatient

This is for NoPatient...Your lawyer mentioned something about USCIS stopping concurrent processing...was it confirmed in the letter to your company from USCIS. Does it apply for both Eb2 and Eb3 cases? What difference will it make for your case if you change it to Eb2?

Thanks in advance...

My dates are close to jdr but still haven't heard about anything.

140: 02/04
485: 03/04

Hairyskull,

No letter to lawyer, CIS sent a memo, it's to everyone. I haven't found that memo yet.

Yeah, it's a big difference to change to EB-2. Have you seen visa bulletin? Starting from 1/1/2005, India, China I-485 have backlog to 1/12002 on EB-3, but EB-2 still keep current. Because my priority date is 5/6/2002. If I'm with EB-3, that means my I-485 will not be processed until EB-3 can reach 5/6/2002. If my I-140 can be changed to EB-2, then I still have hope to get my I-485 approved anytime. Does it make sense?

got the approval notice

Hi all,
My lawyer finally recieved the I140 approval notice ..but she said that only my employer can send me a copy of it when requested...
nopatient,
we have the same problem...we thought that out lawyer filed Eb2 but apparently they filed it as EB3..we just came to know about it a couple of weeks back...our PD is oct,2001...so, maybe not so bad...bec. when we asked our lawyer if she can convert it to Eb2, she said it would be a long process again and she would rather leave it as is, since it doesnt get affected by retrogression...so, we just have to wait and see...i guess.......
these people just play with out lives.....as though we dont have enough problems in life living here....
anyway, good luck to all of us...

jdr,

I stongly agree with you. My lawyer did file my I-140 as EB-2, I checked the original filing paper, my lawyer picked "A mebmer of the professions holding an advanced degree or an alien of exceptional ability( who is NOT seeking a National Interest Waiver)". In I-140 FOR CIS USE ONLY part, there is one segement "Classification", CIS picked "203(b)(3)(i) or 203(b)(3)(ii) Skilled worker or Professional, they should pick "203(b)(2) Member of Professiona w/Adv.Degree or Exceptional Ability."

My lawyer said the same thing. He said since our I-140 was approved before the memo, we should get the visa number assigned. Let's keep our fingers crossed.

I just read this forums. One guy got his I-140/I-485 approved concurrenly. Looks like TSC is not following the memo.

Good luck to us.
