Did anybody used subs. labour first ,revoked it and filed using your own labour

Is any body in the same boat. I recently got my labour certified (after 2 and 1/2 years) from california . Previously in July' 2003 my employer filed a I-140 (alone) using subs. labour

Now I asked my employer to revoke that one and file using my own labour ( 140 + 485). They asked me to reimburse the amount they paid to attorney during filing of I-140 (using subs. lanour)

As per my employer that amount would be $6000 or so. Do you think its a reasonable figure ??? As I understand Averagely attorney charge around $5000 for the complete GC process.

As per my employer they charge heavily if you file I-140 using subs. labour. I fail to understand why it is so.

Can anybody has similar experince or give me a proper advice.

The INS filling fee for I140 Is $135. So apart from this whatever lawyer charges ( depends on lawyer range is 500 -1500) that is the toal coast for I140

since your employer used substitued labour i think he asking for the labour chages that were filed .

Bu t i think 6000 is way too high.

Your are right. The cost for entire GC is range 3000- 5000.

As far as i know there is no separate charge for I140 if they use subs labour. I think your employer is BSing you to get more money out of you.

since you have already filed for I140 in July 03 why don't you wait
till it gets apporved ( should be close now isn't it since it is CSC)

In califormia I-140 is not moving at all since past 6-8 moths....however it went 2 months back. More over thats in EB3 catefory. Employer don't want to file 485 in this case

If I file again using my labour it would be in EB2 category. And I can file 485 concurrently , so that I can get EAD etc.


And I heard it can a calculated risk in using susb. labour.

Anyway Please advice me what to do??

Yes it is But lot of ppl on this forum got approved with subs labout. search the forums

It is your call. If your are willing to pay the fees for subs labour (which your employer is asking) then yeah i would go with mine labour. Looks like I140 EB2 processing dates are May 2003 and for EB3 march 2003 in CSC. Evevn if you get EAD you can't change employement untill 180 days (provided your I140 is approved by then if not you have to wait for that.)

it depends on your willing to pay for your subs labour app which is pending or negotiate with your employer to bring it down to something like 1000 instead of paying 6000 which is ridiculous

what is your H1 status i mean how many years you have remaining??

Thanks Hmd. I am also thinking of filing I140+I-485 using my own labour. I know I can't change the employment unitl I-140 approves. But alteast my wife can work after getting the EAD.

MY 6 years are going to over by July ' 2005.
