Did any of you file I-140 redo after responding to initail RFE

Hi.

when I got my I-140 redo RFE, my lawyer has replied to the RFE with a response back in 8/00 with the
explanation of "Federal Tax-id" being the same and hence no need to redo the I-140. After waiting for
3 months, and no response to my RFE, I have forced my attorney to file for 2nd I-140, which was done
and ND of 11/20.

Now, my fear is that if the 2nd I-140 I filed was being considered a new I-140 and hence would be put in
the general queue and take as long as they do.

If any body in the same situation, I would appreciate your response.

i filed an i140 redo without rfe in mid oct and it is being treated in the regular queue. i talked to iio couple of days back and she said it will take 1-2months (since they are still looking at cases before sep5). so, if your nov case is treated in the regular queue, it might be another 2-3 months before it gets approved.

now, i\'m not trying to scare you ... just letting you know the worst case scenario. there is a certain time limit (i think 3months) within which the adjudicating officer is expected to take action on your rfe response. if the tax-id explanation is not acceptable to the officer, chances are your case will get transferred to the local office.

i think you should really try to get your i140 redo expedited. talk to iio\'s; talk to your lawyer. You might even consider writing to Ms. Linda Dodd-Major (office.business.liaison@usdoj.gov).

I really appreciate it. The last time I talked to IIO around the last week of Nov/1st week of Dec and reminded them of the
new I-140 I filed, she said something to the effect that it has been attached to my I-485 case. when I asked if she could
verify the EAC number of the new I-140, she refused to do that citing that she is not supposed to.

I was also told that my I140 will be attached to my pending 485, when the I140 is approved. Atleast 2 iio\'s told me that and I believe this is based on the fact that my new I140 included my A# from 485. I want it to be included so that no RFE is generated when my 485 is taken up for adjudication. But I guess, I\'ll never know until the fat lady sings ...
