I am in the process of changing job. The new employer is saying that I can start working with them from the very next day, after they file H1B transfer application. ie I don't have to wait for the receipt. Is this true? They are asking me to give 2 weeks notice immediately so that by the time they file H1B, 2 weeks will get over, and I can start there immediately.
Please reply its kind of urgent for me.

Thanks.

I am in the same situation. I am transferring H1-B from Univ A to Univ B. Univ B says that I can start work as soon as they send in the application to USCIS. (My H1-B with Univ A is valid till May 2008 and now transferring to Univ B). I am saying that I want to wait for the receipt. But I am not able to convince them since their lawyer says I can start. Good to know that the law actually states that we can work as soon as USCIS "receives" our application.

Let us say I start working as soon as they send in the application. But, IF things go wrong like unitednations mentioned, say due to carelessness of Univ, whose responsibility is it? Will I become illegal or out of status in the mean time? And can the Univ or company make recommendations and fix the problem, if such things happen? Or is it going to be OUR responsibility no matter who makes the mistake?

Thanks,
PD

Not sure if you have a pending/approved LC, but what's your current employer doing? Are they keeping your case open? If they're not keeping it open, what happens to you on your new/transferred H1?

paystub without h1 transfer receipt dt

1. Dont do mistake by merely trusting employer word and start working for them without receipt notice. By employer's word i have started working for him, but my h1 transfer packet returned saying the fee was incorrect. my employer has informed me almost after one month. during this case, i should stop working or should i continue working for my prev company? damn thing is he is giivng me labor free of charge though he is lasiest employer in the world. good thing is i am still working at clients place and changed my employer.

2. i have not yet received my receipt dt, so i hadnt send my timesheet to current employer. He saying he will generate payslips even prior to receipt dt, how can he?? seeking suggestions from fellow employers.

I just want to share info and warn feloow h1'ers!!
