My I765 EAD application has been pending for 100 days, so I decided to go for I EAD at Detroit.
The courteous officer from local BCIS informed us that Local office cannot give I-EADs as my file is with NSC. I will have to deal with NSC for EAD.
I pointed out that according to both Detroit-BCIS webpage as well as I765-form, if I765 is pending for more than 90 days one is eligible for I-EAD from Local office; moreover other offices are giving I-EAD. To this he replied that his supervisor has told him not to issue I-EADs so he cannot issue one.
I told him that my H1 visa is expiring next month and after that I won't be able to work after that unless I have an EAD, to which he replied that I can show EAD receipt (?) to my employer and explain the case to him, maybe he will allow me to work(!?!). I asked him is it legal to work when the petition is in pending status and he said he cannot answer that!
Deciding that further discussions will be futile I returned.
Plz advise ... is it possible to get I-EAD from a different office?
