Desperately need help

I was laid off in January 2002.....(H-1 valid till 2003)
I have a job offer which starts in August 2002.

My question is can i do a direct transfer of my current h-1 for the job which starts in August? Will i be in status till August?

i was told that u\'ll be considered to be in status as long as the second employer files for a transfer immediately. even if the petitiion is pending ins approval, stayin in country is legal.
