To go with 485 or not:

Here goes the details:

1. Working with company X
2. Labor approved job title A with company X
3. Company X goes bankrupt when I 140 is pending but ready to support future employment. Laid off employees. but ready to hire in future if funding comes through. not cancelling h1, continuing 140,
5. I join company Z through H1 transfer.
4. I140 approved company X

5. Can i go ahead with 485 with a future employment letter from company x while working with company z

Using AC21, can i show employment with Z (similar job title and description) when i go for the interview. can i use the 180 day rule if the application was pending for more than 180 days.

What do u see are the chances for approval for this kind of a case?

It\'s quite simple

Actually, you have multiple options:

1. You can take a chance and show future employment with Company X - however, that\'s not going to fly so easily with the INS. THey will most probably send you and RFE asking why you left, and also for financial viability of Company X to actually hire you. Besides, if they DO go out of business by the time your AOS rolls around, you\'re screwed.

2. if you can use the 180 day rule, then joing the new company, and use the old I-140 to get your AOS

3. Another option, if you cannot use the 180 day rule is to use your EAD or H1 transfer to change jobs, get yourself a new I-140 through the new company, and then simply use that I-140 with Company X\'s AOS.

you sound like an expert!! I have same problem. I left job during the I-140 pending. now I got my I-140 and found a new job with new H1.
as matter fact, i have already applied a new labor certification with my current company. but i heard the chances to be approval are rare. I have surpport letters for my 485 filing from my old company. should i just go ahead file my 485 based on the letter they give to me? or it is better to ask for a future employee support letter?

you can use old priority date

Even if you have to start all over again , you may be able to use
your old priority date. I dont know if this may actually expedite your labour and 140.
