Case transfered to Memphis 10/12/06
Interview at memphis 1/9/07
Name check pending, cleared for spouse 1/9/07
Wrote a letter to First lady to expedite NC 5/07
Response from FBI saying- in process 8/07
Actual NC cleared 8/07
Invoked AC21 but did not file 1/10/07
Case transfered back to TSC 10/07
Infopass appt.- 12/20/07 Confirmed NC cleared, case with IO for approval
Dependents approved 01/25/07
Cards received for dependents: 02/05/07 (cards were sent to old address even though address change was in effect)
Cards say PR since 9/25/07
Still waiting for primary!!!!

I am happy to inform that I am also approved today and received card ordered e-mail. :D:D:D


Thank you all who are participating in this forum and it made a lot of difference in my case. I learnt a lot of information in this forum as a regular reader. In particular, letter to First Lady to push name check, Fax to TSC director last month (apparently now they disconnected that fax number), confidence not to file AC21 after change of job are few to mention.

I am in the same situation. My wife and daughter received their GC last month, but I, the primary (EB1), am still waiting. I don't even have updates recently. Could you tell me what is the advantage and disdavantage for filing AC-21 when you change job with a pending I-485? Thanks.

I suppose your NC would have cleared last October timeframe and have been pending still. They approve derivatives only after NC is cleared for primary (situation then). Unfortunately when the case goes to review some officers are quick and some are not. In my case, the officer took 4 months for review which is normally 30 days in TSC. So We have to be behind them pushing by all means. I beleive in your case as well, you have to find all means to communicate to move the case forward. I used infopass (local office was very helpful), faxed to TSC director (after which my derivatives actually got approved), I also talked to Congressman (but it takes atleast 90 days), CIS ombudsman, POJ etc.

I used AC21 option to change job but per my attorney filing AC21 may further complicate/delay the processing. Also the AC21 law is unclear and can be intrepreted both ways. However one problem doing this option, is during applying for citizenship they may raise this issue. I decided to go by my attorney even if USCIS issues NOID, I was prepared to prove the job was similar.

Finally card received for primary too

I also received the GC and the approval notice today from TSC. Finally this puts an end to all immigration concerns.
