I have a retrogression query. I got my 485 approval (EB2/India) in april (PD 02/2002). For some reason (VSC said background check on enquiry), my wife's approval is pending. She is a derivative applicant and we filed concurrently

Does anyone know if the approval/processing for her case can/cannot happen during retrogression that will happen starting 1st August for EB2/India

If her background check is not complete and she is not approved before Aug 1st, she'll have to wait for (your) PD to become current before her 485 can be approved.

Urgent Question About Spouse's 485!!!

Dear friends,

My 485 was approved in 2004 and my wife's was stuck in retrogression. We had sent a query in Oct 2005, for which TSC replied that they're doing further review (note: no mention of background check in the written response) on the case and we should contact them after 6 months. We sent a second query on July 7th and they replied that visa numbers are not current, which is not true. So, we faxed an expedite request with my LC and all related papers including our marriage certificate, bank accounts etc (to prove we're still married) and her case was updated on the same day and the status 'we responded to your request for more information concerning your case. If you have not received our response within 30 days from this date, please call customer service at 1-800-375-5283.'

If we wait for 30 days, her case will be retrogressed again. I read some archives about this status and some said it may be a medical RFE, others said it may just an updated due to address change and someone even mentioned that it could be an approval.

In our case, it is not for the address change. I don't think it is an approval either.

Since my wife's medicals were sent in 2004, it may have expired. So, I'm guessing it is an RFE for medicals.

I have the following questions:

1. How long is the medical valid?

2. Is it safe to assume the case status update is definitely a RFE for medical and send it before I receive any papers?

3. If so, where do I send it (our service center is TSC) and what is the process, since I don't have the RFE itself?

We only have 10 days to get something going before her case goes into oblivion again.

Please help!

Thanks!
