dependent I130 PROCESSING

I applied i 130 for my wife in F2A category for dependent green card. It will probably take a while for CIS to process applications with PD October 2010. In mean while if we have any kid, would I need to apply for a new I130 for the kid with a different priority date or there are any provisions for the kid to be united with parents faster?

Hi harsha_c,

There is an application which is appropriate for individuals who have adjusted status to Lawful Permanent Resident in the U.S. and whose family member(s) will apply for an Immigrant Visa at a U.S. consulate abroad. This process is known as "follow-to-join", Form I-824. Only if the child is born before you are a LPR its possible to use this form and used when you are outside US. If this form is used you need not wait for Form I-130 approval. Now that you are already in US I am afraid you need to apply with a new Form I-130 for your kids in future. Good luck!
