Dependant/derivative QUESTION

Everyone,
I wanted to ask you if any of you had a similar situation. Up to the FP notices, my husband (dependant) and I were receiving the notices the same time. My I-485 got approved and his hasn't yet. WE did FP the same day. I did the PP stamping last week and had several LUDs but he hasn't yet. When I called TSC, the agent told me to wait. She said that our cases were seperated and she sent the request to a supervisor. Have any of you had a similar experience? If yes, how long did it take for your dependant applicant to receive something? I had been on H1b and he has been on H4. Since my I-485 has gotten approved and I had my PP stamped and all my I-94s were collected, his H4 status in not valid anymore. I did not apply for EAD or AP for him. Any advice or input will be greatly appreciated.

My 14 year lod son's case is separated and I am following up on a weekly basis to get him approved.
All of us were approved on March 30th, and we are waiting for his approval.

Due to yours husbands pending 485 he is in status until his case is decided and he does not need EAD or AP to be in that status . However if he has an H4 visa stamped in his passport, he might not be able to use it and you should get yoyr attorney,s advise on that.
I hope your husband is approved soon too.

I call TSC every week and see if there is any progress on my son's case.

I had good result from calling them as I called every day and had them send FP notice for him.

He was finger printed on May 18th and since then I am waiting for some progress to his case.

Some at the TSC say he needs Name check and some say he does not but I do not care as long as they do some thing to get his approval.

You can file for your husband's EAD and AP if you have plans for him to work or travel .
Other wise he is fine.

The reciept he received for his filing the I 485 as a derivative will be his ID till he gets his approval.

I used these for both my son's where ever required ( Driver's License and college admission for 19 year old son ) and they were accepted with out any problem.

Your husband and you have nothing to worry if he is not planning to work or travel immediately.

Mine is a similar case. pl. see signature below. my approval was 1/20/05 and my wife's case is still pending.

i agree with what most others responded in this thread. i will caution you on one item. if you think your husband will need to travel outside the country (normal or emergency ), it is better to have AP in hand. also, once you apply for AP, until you have the approval in hand, it is advisable to NOT leave US. typically, it takes about 1 month nowadays to get AP approval but you never know with TSC and the ever-changing times. it is best to spend that $165 or $175 (whatever it is now) for AP filing fees and have it in hand. who knows...maybe the officer approving the AP may look at the 485 and trigger some progress on the 485! (just wishful thinking here:))

Ellada, I think your husband's H4 is extinguished. He is now just an "adjustee" which is fine, unless he wants to travel. For travel, he'd need an AP.

I actually have a very similar situation. We have received emails that my husband's and my I-485s were approved last Friday (7/8/05). The LUD on our 11 year-old daughter's case was updated last Friday also, but her case status message has not changed and we've had no emails about her.

Meanwhile our daughter is in Canada, on a summer visit to her grandparents. She doesn't have AP because she has (had) L-2 status. Our lawyer says her L-2 status is extinguished by my I-485 being approved. (I had the primary L-1 status although my husband was the primary for I-485.) Anyway, our lawyer says that if her GC has become separated our daughter is stuck in Canada! We sent in an AP application for her yesterday. It could well be that her GC has been approved too, just the online case status is not updated, but we can't tell that right now. This situation with our daughter is certainly clouding our delight and relief at getting our GC approvals.

Hope you get good news for your husband soon. But maybe, if there's any possibility he might need to travel, he should also consider applying for AP.

When you call, do you speak with agents at TSC?

I always talk to Agents in TSC.
If I cannot reach them, I simply disconnect and try again.

I asked because a couple of times when I called, one of the agents was not very nice. She said, "You need to wait and not call again......."
I guess we will see.

Call at a different time as we encounter different people with different attitutes in our lives.


All the agents so far I have spoken to at TSC were very nice.

Keep going no matter what your experience is.

I am in the same boat. My wife's I-485 got approved on 6/7 while mine is still pending. We filed everything at the same day.
I called TSC, some one said they are waiting for my Name check and some said they have everything. I don't know what I should do for the next. Maybe the only option is just waiting. Any advice? Appreciate your idea, always. Any more people have the same experience?

I think waiting is the only thing we can do. Keep us posted about this. My husband is asking me every day about news. We will see.

please tell me what exactly u do when u call tsc ???? what options u choose so that u actually speak to an agent there???? any help on this matter is greatfully appreciated....

You call the 800# listed on your notice. Follow instructions through the point when your choice is "if you think your cases were seperated"--that will take you to TSC: an automatic message will come on--wait for a few minutes and an agent will talk to you. IN previous discussions, POJ had the exact numbers that you enter to get to TSC but I don't have them written down. If you want, search and you will find it.

I guess I called so many times I do not need them written any more.

Go to search and type your search word and that should bring up the written steps.

I can try and remember but I do not want you confused.

All I am recalling is

Dial 800#

Press 1 (English)
Press 2
Press 6
Press 1 (for SRC no)
Press 1 (to confirm SRC #)
Once u heard the status (if u have error on status use any other SRC even old one)

After listening Status

Press 3
Press 3 or 4 when it says 'You have filed Multiple Applications, and seperated " Select that option.

Hope It would connect directly with TSC.

I wanted to ask you about my husband's pending case. He was assigned an A# at FP. Do you think he will have to wait till after October 1st to get some good news?What do you think?
