Denied Entry at POE at U.S.C.

Hello, I have a situation that maybe someone can help me with. I would like to apply for citizenship as I am eligible. The problem is, (I think anyway) is that I was denied entry into the U.S. while awaiting AOS for my greencard. I didn't apply for an AP before traveling to Canada to attend school, out of my own stupidity, I just didn't know.

Anyway, what are the chances of this denial being dug up when I send in my N-400? What might the implications be? Thanks.
 
It shouldnt be a big deal considering it was an innocent mistake. However, recommend you get a lawyer to help you out with the N-400 process - especially important that he/she accompany you to the interview.
 
Realisitcally, yes an innocent mistake - but I guess the question is will the interviewer see it this way if they were to uncover this?

I wonder if they would uncover this now, since they didn't when I got my GC? Does anyone have any ideas on this. Thanks again.
 
DaveB - these are tough questions, and realistically you can only hope to get personal opinions on this issue from this forum. Each N-400 case is handled differently, so it may not help you even if somebody else had a similar issue.

Engage a lawyer, explain the full situation, understand your options and act based on what you know. At the end of the day, it is up to the interviewer. From a gut-feel perspective, you should not have a problem, as long as you havent lied or done something illegal like sneaking across the border.

Also recommend explaining the whole situation to the interviewer and not hide anything - just being denied entry is no cause for denying the N-400, lying or attempting to hide information could very well be.
 
Well - the issue at hand is whether he lied or not. It is still upto the USCIS which can always use its discretion to grant a GC, even if a person did not take an AP during status adjustment. If the GC was obtained fraudulently, DaveB might have bigger problems than just not getting citizenship.

DaveB - like I said before: get a lawyer - you are unlikely to get any help in this forum for this issue - just opinions.
