Denial Notice (Extremely Urgent)

Hello
My wife had her first passport stamp in March, 2001. We waited for a year and there was no sign of the actual green card. She went back to the INS Atlanta center in March, 2002 and got her passport stamped again. We waited a year and she went back to the INS Atlanta office again in January, 2003 and got her passport stamped again.

Yesterday, we received a denial notice from the INS which states

"Your application to replace Alien Registration Card, Form I-90 is denied. You have failed to establish that you are a legal permanent resident of the United States. There is no appeal from the denial of this application"

I am at a total loss. Here we are doing everything possible and legally and finally the INS sends us a denial letter. How serious is this issue ? What can be done to rectify this massive INS error ?

Any help is greatly appreciated.

Thanks in Advance

Contact a good immigration attorney immediately. I hope you have copies of 485 approval notices and all other approvals like I-140 or I-130. This must be a mistake and INS must have made an error on the application. Double check to see that the A# number on the passport matches A# on the approval notice.

Thanks for the post! Guess what, yesterday we received yet another mail from the INS describing why her petition was denied. Basically, the local INS Atlanta office somehow generated a new SRC number in March of 2002. This SRC number did not have anything to prove that my wife was permanent resident. Today, we finally got her green card that was generated under the original SRC number that was filed as part of 485 processing.

Thanks again!
