Since GC is for future job, If you are in good terms with your employer ask them to give an employment letter stating Now your current salary is yyyyyy but on approval of GC you will be paid xxxxxx.

Otherwise Denial - Cause Not compling to Labor Certification.

From where did you get this info?
Is there any denial case recently due to this reason?
If yes, what was the salary difference?
Thanks

I am telling the law. Denial happens when the GC sponsoring company declines to pay the LC salary and mention on the empoyment letter.

I donot think so rajiv.
Please read some previous threads. There have been approvals even thogh there was a good difference.

It depends on the officer but the law is that. Unless you appeal in the court the denial and prove there. I am now close to a immigration Attorney but just dont have the degree.

rajiv

u r almost a lawyer..but evidently u need to attend a few more courses to qualify..and when you do...then maybe you can give your legal opinions..till then u r like us...:)

Yes unfortunately  tired of the GC process

I say 'Beet Gaya Jawani GC ke peechey'. Now I dont even know if they give me a GC. Its better I go back. Atleast live in peace.

Hi Rajiv,
Looks like you are not visiting this page recently. You missed out a lot of postings. Don't boast about your knowledge here and don't post your own laws here. The thread Title itself needs improvemet. It would have been better if it said something like
"LC Salary issue" or "Current Salary Vs LC Salary ". You should have posted more details about the source of such a law. On reading your post, i thought that you are quoting your experience.
It is so misleading. Hundreds of people post their experinces here and a lot of them had a current salary much less than LC salary and all of them got approved. There was not a single case of denial till date. You should have used this common sense before posting your thoughts here.

Don't worry you would get your GC. Get your GC, then if you need a break take 6 months off , go to India and come back.
