I received my conditional Green Card through marriage. It was due to expire in September of 2015, so I jointly filed my I-751 in July of 2015 with my husband. My case was updated online with USCIS in July to show that it was received. I had my bio-metrics appointment in August and settled to play the waiting game. I was issued my I-797 extending my eligibility to live/work in the U.S for a further year, until September 2016.
My marriage began to breakdown a couple of months after jointly filing. We separated in October. I was advised by an Immigration Lawyer that the USCIS is very black and white. That they see you either as married or divorced, so there was no point in me contacting them to let them know we were estranged. In January I received a request for further evidence. I sent in more supplemental documents. In March, I was asked to come in for an interview. At this point, my divorce was still not finalised. My attorney and I prepared an extremely thorough binder of evidence and I was accompanied with my attorney to the interview. It went well, I was told I would be issued another request for more evidence - to send my certified divorce decree once I had it. I sent this as soon as I had it, in May of this year. I got confirmation that they received this on May 20th of this year.
At this point, 93 days have passed since they documented receiving the final piece of evidence they needed. No online updates and no mail correspondence. I'm getting concerned, because in 2 months I will be moving to a different state, that works out of a different Service Center. I'm concerned that I'm going to be back at square one and have to find a new lawyer to represent me.
Has anyone experienced anything similar or does anyone have any knowledge about the normal timescale for this situation? There was not question of the legitimacy of the marriage. The holdup lies in the fact we were converting my joint filing into a self petition.
