Delayed I 485 Processing

Hi,

I have applied my I-485 in 2004 july. I come under shecdule A category for whom visas are current. My file was stuck in FBI Name check till may of this year. I came to know from my senator that is was cleared on may 18th of 2006. Every body told us that we should get green card in 2-3 months after that, but its been 4 months but we havent heard anything. When we enquired recently through senator ,CIS replied that it is still in back ground investigation( internal security review).Our problem is, by next month visas for shecdule A wiil be over and merged with EB3 category. Then we dont know when we can get our green card. We want to consider sueing CIS but need suggestion from any body who have done it before or know about the process.

WRIT OF MANDAMUS is the only thing that will help. Call a good lawyer and discuss this who knows about this writ

i am in same boat...

I applied in 2004 too under schedule A. I got RFE on I485 in july 06 but since then nothing happened. I am affraid too that we will miss the boat and hit the retrogression. Write to me and see if we can do something together. It will be unfair if they count people who applied after us to schedule A and we are left out because of security checks and all.
