Delay in Receiving Receipt

My lawyer claims that he sent my I140 application on Feb 13th 2004 and that they only received the receipt last week on May 13th. When I check the status, the Web says that the I140 was received on May 6th, could it really take 3 months for them to issue the receipt or is the lawyer lying to me?

Any ideas? What do you think?

It could be that your lawyer mailed it late. If he had really mailed in March, the Notice of Receipt could say the RD as March and ND as May.
But your lawyer could still claim that it was mailed in March.

I don't think you can verify it. You should have followed-up in March and ask for some mailing receipt, tracking number etc.
 
PhillyDec01 - The INS says they received it in MAY not March!! It would have had to have taken 3 months for the receipt to be issued if they really sent it in February.

I did not even know that they had filed for the I140 as I already had one application being processed. When that was approved they then said that they we needed a second application becuase my company had been taken over. I should have been sitting in the US Consular building getting my greencard around about now but they keep coming up with shafu's like this one.

It is killing me!!!

I just got this response from the lawyers, does it sound legitimate?

"The online system date is incorrect. The date appearing on the website is
the date the receipt notice was printed rather than the receipt date. The
date printed on the receipt as the "received date" is February 17, 2004 and
the "notice date" is printed as May 6, 2004. You should use February 17,
2004 as the receipt date and disregard the date reported on the online
system."

Do they process them by RD or ND?

Do you have the receipt notice. If not - ask your lawyer to fax it to you. You will know the truth.

Processing is done by ND. The date on online system is actually your ND(**) - your laywer is right, but I doubt it took 3 months for generating notice!

**For service centers ND is RD and what we call RD is the date when contractors recv your applications.
 
I just spoke to him - I have it in writing that the RD is Feb but the ND is May. He says that this happens sometimes, they just don't send receipts for months in some cases. He promises me, however, that my case will be processed with the Feb cases.

I guess I'll know in 4 or 5 months....

I hate this!
 
Oh Pemple - you are so naive. Your lawyer is acting smart. Ask for your case number - it will be EAC 04 XXX YYYYY.

XXX tells the number of working days since Oct 01, 2004 - that is your notice date. Your application will be processed in May lot only.

Reciept is generated and sent out within a week always.

I know, that's why I called him, and the INS too. The XXX is 159 which sounds like a May ND to me. His answer to this is that the case number is generated when the notice is generated but he assures me that the receipt shows my RD as February and the ND as May. The problem, he claims, is that they did not generate the notice until this month. I asked him specifically whether they would process my case with the Feb or the May cases and he is adament that it is with the Feb cases. If it is not processed within 30 days of them getting to the Feb cases then they'll call up and chase them.

They have a Web site that contains all of the case details and it agrees with him, I also have the automatically generated email that shows an RD of February and a ND of May although the INS's web site shows May for the RD.

What he says makes sense and he is usually very good but in this case I do feel like I am getting shafted! Bear in mind that I got an I140 last month so this is my second time round the block in less than 12 months!

I'd be more paranoid but I think that they really do hate me!

Yeah Pemple. I remember you post about CP in London and company merger. It must be tough for you. However I have seen people where correction of 140 has been done very fast. So keep your finger crossed.

By the way - would you mind posting your details in 2004 tracker so that we can track your case too? :)
 
Sure, I'll add them today - Thanks for the sympathy but if it takes 3 months to send a receipt how long will the I140 take :confused:
