Definition of temporary resident immigration

We arrived in WA from Canada about almost four years ago. I have been working since then and my wife worked until one year ago. Both of us worked in High Tech industry. We hold work visa and we are in the process to become the permanent resident (Adjust of Status, RD 04/30/2002). We live in Bothell. My wife now is trying to become a nurse and going to the college. We are required to pay the non-residents tuition. But it seems that we can be classified as 'temporary resident immigration', which we would pay the instate resident tuition fee. Does anyone can give us some advice?
 
Can't you apply as an in-state student?

I myself got an admission in local university for MS as in-state student, when I was on H1b. They needed a proof like driver's licence, SSN, Employeement proof etc.
 
WA is the most discriminated state for forgein students

I double checked the bills they used. On one hand the bills say if one student has established 'domicile' such as Driver License and Bank Account, blah, blah, he is a resident. On the the hand, the say the non-resident should include 'A person who is not a citizen of the United States of America who does not have permanent or temporary resident status or does not hold "Refugee-Parolee" or "Conditional Entrant" status with the United States immigration and naturalization service or is not otherwise permanently residing in the United States under color of law and who does not also meet and comply with all the applicable requirements in RCW 28B.15.012 and 28B.15.013.'

Non-residents have to pay almost 4 times as the residents. This kills us.
 
It depends

I think it depends on the state. In WA, they have stricter "rules" when considering in-state status. In Texas, for eg, it was enough to be a resident for 1 year or so, to be considered as in-state.
 
Unity in diversity is the principle. No two universities or states have policies in common, particularly with tution fee. One has to face these until one gets his/her GC.
Any visa holding person can go to community college to study and get grades, his/her tution fee could be similar to residents, but if he/she wants to register for a "degree", most universites/states treat them equal to F1.
