Deficiency letter from VA SESA

Hi immigration gurus:
VA SESA representative told me that they have sent a deficiency letter to my attorney today. Did anybody receive this query... What do they usually query about????? ( My lawyer hasn't received it yet) ...

Any body have an idea on what SESA is querying for ????

Hi there,

SESA or SWA mails a deficiency letter, if necessary, to the attorney or agent and/or employer if the application requires amendment and/or has missing information per USDOL regulations and Regional Office guidelines. The deficiency letter provides a 45-day response deadline to correct deficiencies before recruitment commences.

what exactly do you mean by "correct deficiencies before recruitment commences" .... My labor was applied with EB-2 RIR ...
what exactly do u mean by "commencing recruitment" ...

I was under the impression that my company already advertised and is using RIR ...

My company/Lawyer has a 007 secret policy and don't reveal much info ( which really pisses me off .. but i can't do anything .. Big5 consulting with useless lawfirm:FRAGOMEN-DELRAY ... ).

Lawyer still waiting for the deficiency letter ...

Dude,

I think and this just an intelligent guess: May be something was left (not in 100% compliance with DOL guidelines) out during recruitment efforts made by your company. I hope this is something minor, which can be fixed with very little extra effort.

I feel you man. I also work for a very large company. I know what you are taking about when it comes to dealing with big law firms.

LC is pain but once you get it.....rest of the journey is painless. Working for large corporations makes I-140 and I-485 stage lot easier.

It could be anything. Something could have been forgotten. SESA might think the salary is too low. SESA may feel that recruitment is lacking, that a qualified applicant applied and should have been ciontacted, that the job title is not correct, or a dozen other things that I could name.
 
Case put on Hold

One of my colleagues received a letter from Phily DOL telling him that the case is put on hold and to wait until they respond to the case.

Before this two other guys got two approvals and this guy was also optimistic abt his approval. Now, he is confused as to when a decision will be made in his case.

Anyone had such a experience???


Any help would be appreciated
 
What this guy confused about, they are waiting for HIS respond.

May be I didn't make myself very clear. PHILY DOL has asked the guy to wait until they(Phily DOL) makes a decision on the case.

According to the letter, it sounds like the DOL has kept his case on hold for some reason which has not been specified.
 
Is that response came along with some other issue????

I am surprised that Philly DOL had taken time to write a letter to the applicant to hold on and wait without saying anything else.

My company changed its name after submittting my labor petition in early 2002... So VA SWA asked to submit a amended labor petition with the new company name. They gave a 45 day's to respond to the deficiency letter ...
