Decrease in Salary and I-140.

In my labor application for GC my salary was mentioned as 70K.
But, now I make 60K (since last 1.5 years).

When I mentioned this to my lawyer he told me that,
this will 100% lead to RFE or denial of 140.

What is the way out of this.

I am filling for H1B extension(7th year).My previous LCA for H1b said 60K. Now the lawyer says that if I do not do 70K for new labor (for extension for H1B) it will mess up my I-140.
My company cannot increase my salary at this point of time.

Hi,

If possible switch to a different project/client with better billing rate and ask your employer to hike the salary.

green card is for future job. the salary mentioned has got no connection with your current one. ofcourse there are some restrictions.

salary is based on your designation and location. for example if you are systems analyst and you are located in some X location then the salary which you currently draw should be more than or equal to prevailing wage determined by dol. that can be the same for gc also.
