Decision time for me to start working for GC sponsoring employer - Please suggest

Hi ,

My situation is as follows:

Current Employer :
- Working since May/2003
- Labor approved in May/2007 (Labor Date : June/2003 , EB3)
- I-140 / I-485 NOT filed upto now

Future Employer :
- Filed I-140 in Dec/2006
- I-140 approved in March/2007 under Labor substitution [PD: May/2001 , EB2 (I have Bachelor plus 6 years before May/2001) ]. Approval category : Mem of Profession w/Adv Deg., or of Exception'l Ability Sec 203(b)(2)
- I-485 Filed in May/2007


I am planning to start working for the GC sponsoring employer starting Mon,Nov/05/2007. Is it OK from GC perspective ?

This is a last moment sanity check for me. Please suggest !

I think I am doing the right thing.But doubt is : Am i missing something ?

That should be good.
But I would suggest not to burn any bridges with old employer just in case you
may need to use that labor in future under any unlikely circumstances.
(He cannot use (substitute) it for anyone else now, so you're fine on that front.)
Also if still active and possible, transfer and maintain your H1B as well.
 
Hi,

I think now labor has an expiry (even if it is pre-PERM labor).My labor was approved in May/2007 and I-140 has not been filed yet.

I think, USCIS gives 180 days between labor approval and I-140 filing.
My 180 days will be up in next 2 weeks times !

Will it be helpful to keep H1-B ?

Hi , if it is the same type of job , as the one is sponsoring you , i would not worry to much !!! Just make a decision , an keep the one where you feel happy to work for !!!

Since, I am planning to join the FUTURE employer, i can make sure that job profile and job title matches what is on the labor.
