December 2007 Bulletin out

Weird is an understatement. They @##$# up the dates in June/July and now move dates to pre-historic times.

See this part:

E. IMMIGRANT VISA AVAILABILITY DURING THE COMING MONTHS

CHINA-mainland born and INDIA:

Employment Preferences:

First: Continued heavy demand may require the establishment of a cut-off date at some point during the fiscal year.

Second: Demand during October and the first week of November has already used over 38 percent of the annual limit. It is hoped that the December retrogressions will return monthly number use within the target range. If not, further retrogressions cannot be ruled out.

This was expected. With over 300,000 filers for I-485 in July/August, did you expect EB3 dates to move forward?

They cannot stop giving 28% of 7% of 140K which is limit for individual country/category. The gates will open again before end of FY 2008. Ofcourse, not as wide as it opened in July 2007.

And, 485 is not a 100% solution to the problems. Guys in CP have made that decision based on their own judgement and they have their own reasons to do so.

And not everyone who has a need to change job will do so even if they have EAD. Majority of the guys are scared to use AC21! That's the reality.

I am not justifying CP but at the same time does not want buy the argument that 485 is THE solution! There are several waiting in the name check queue for close to 3 years!! No fun, even with an EAD/AC21/AP.

After using AC21, GC is a luxury which will come eventually.

With CP, you have no luxury. You are doing bonded labor for your company (assuming that your employer is a desi company). If American company, you risk the case of loosing your job due to layoff and to start GC all over again, if you can.

I pity you that you think you are 100% safe if you have 485. How many times will you change job with AC21 (though there are no limits).

Dont you think guys who have gone for CP knew that there is going to be a long wait and despite that they have chosen this? And who said ALL desi companies treat their employees as slaves???

If you are happy that you have chosen 485 path, let it be. Looks like you are talking agianst CP in every posting of yours!! Not sure about others. Atleast I do not want EAD/AP/facility to use AC21. If I lose my job because I am on H1/CP, I will take it as it comes. I did not start my life relying on GC.

I do not need your pity. I have !@#!@ myself badly over the last few years, making my GC case a mess. Taking wrong decision time and again.

Most of desi companies treat their employees as "BONDED LABOR" (Thank you #@#@$$# USCIS / @#@#@$# Immigration Process). If your company does not, either you are lucky or just plain ignorant (check your bill rate vs what you are getting paid, you are getting ripped off big time.). These companies take advantage of the GC process and suck your blood. Look around you.

Once you have started a GC process, you want to finish this right? I am not against CP. I was for CP all along (and @#@$ myself in the process). Then I realized that getting out of this job where my blood is being sucked is more important. That is the reason for I-485.

In fact the main advantage of CP is there is no issue with name check.

Finally, it is all in one's fate. CP/AOS, if your GC has to come fast, it will, otherwise, you may do whatever you want to do, it will take its own time.
