Hi

We are planning to file N-400 for my mother in law who has been a permamanent resident for over five years in the US. Her husband passed on about twenty five years ago, and we do not have a death certificate. Is this needed, or are any alternate documents admissible as in the case of a birth certificate?

Any advice is deeply appreciated

George

Sorry, I am not sure what would be acceptable and what your native country is, but commonly one has some form of documents (pictures etc) that could help swearing that it's the truth.

Remember - many documents got lost during WWII (which was obviously prior) and people would face the same problem. So there NEEDS to be a way to overcome this.

Did N-400 even ask for a death certificate for the spouse who passed away in the first place anyway?

Yo - status of your marriange - proof is asked for divorce or death

I only see that for prior marriage not for current marriage. Unless a widow
need to count his dead spouse as prior marriage not current one.

USCIS care that much about status prior marriage because of Question
22 (d). They want to make sure one is not a polygamist or has commited offense of polygamy,

Yo, and to ensure that you need to prove that the previous marriage is disolved.

Just go that extra little mile - state it in the N-400 and everything is fine - do not omit stuff ever.
