DCF in India, and residence requirements.

I have been told by people, a few of those said they are mentioning it from their own experience,

its that, if USC stays in india (in my case india) for 2 months, they would be eligible for DCF so that the wife (with no immigrant status, and an indian citizen) can migrate to america. a speedier process than CP or K3.

any comments. if its ryt, i am gonna give it a try.
 
I think it is 6 months residency, not 2 months. Please see the website of US Consulate in Chennai which says:

"If you are a U.S. citizen legally residing in India and want to file an immigrant visa petition for an immediate relative, you can file a petition at the USCIS Office in New Delhi if you have been continuously, legally resident in India for at least the 6 months prior to petition filing. Individuals who are in the country on temporary status, such as a student or a tourist, do not meet this residency standard and must file an immigrant visa petition for an immediate relative in the United States."

As I mentioned in my other posts, I filed DCF for my wife from New Delhi. Am working as a expat for US Company and on 2 yrs assignment. In New Delhi, they asked me the proof of E visa, employer invitation letters, pay stubs showig salary in Indian terms, House lease agreement etc., So, it seems they are checking whether candiate is really residing in India or not.
Based on that, they are taking the decision. So, I think you should give a try. I have noticed on the day of filing in New Delhi that few other families who are in similar boad ( like u ), they filed and got ok from US Embassy for further proceed of the case. If they accept the application, then whole visa process can be finished in 3 to 5 months max.
