DCF from New Delhi consulate question

Hello,

I would appreciate if any one can answer this question.

According to some news, New Delhi US consulate requires 60 days stay in India for US citizen before taking DCF [ direct consular filing] application. i.e. I-130 for a spouse.

Is this an absolute requriement or has any one recently got DCF processed WITHOUT staying in India for 60 days time period?

Yes you do have to stay in India for 60 days. The New Delhi embassy will not let you in without your 60 days of complation. They check your date on your passport before they let you inside the embassy.
I done this month.

Is DCF only for people who get married after they get their citizenship and then file I-130 or is it also for people who already filed I-130 when they were permanent resident and now they are citizen??? Thanks for your response.
 
i married when i was permenant resident and then after year i become a citizen and i went to india. Live there for 60 days as per rules. File at New Delhi embassy. so i dont think so there is any rulse that you should file before or after citizen.
Also DCF is much faster then other method and you can argue that you want to file DCF instead of filing at your near INS office because it faster for me to brining my spouse to US with me.

DCF is for ANY US citizen married to an alien. Marriage/Natz before or after has no impact. You need to be a citizen and married to the beneficiary. Thats it
