Daughter's Consent!

Can a mother who is an American Citizen sponsor her 22 years old daughter for a green card, without the daughter's consent? I would think that the daughter would have to sign some documents etc....

A USC mother can file a petition (I-130) for her daughter without her consent. But the Green card application should be filed by daughter not her mother.

The I-130 is filled and signed by the you, but one set of the accompanying G-325A has to be completed and signed by your daughter. And thats not all, the rest of the forms needed for AOS has to be completed and signed by her.

To answer your question. NO. Her signature is needed on all the forms (except I-130, but she needs to sign the G-325A that goes with the I-130).

The answer is YES. G-325A should go with I-485. To file the petition this is all that needs to be sent:
"If you are a U.S. citizen applying to bring a child or son or daughter to the United States to live and you are the mother of the child, you must file the following with the U.S. Citizenship and Immigration Services:
· Form I-130, Petition for Alien Relative
· A copy of your birth certificate or U.S. passport
· If you were not born in the United States, a copy of either:
o your Certificate of Naturalization or Citizenship or
o your U.S. passport
· A copy of the child’s birth certificate showing your name and the child’s name
· If anyone’s name has been legally changed (if it differs from the name on his or her birth certificate), evidence of the name change must be submitted."

Lets get this straight. I overlooked the part in the instructions where it says G-325A should be submitted by the beneficiary only when the beneficiary is the spouse. So in this case, daughter does not have to fill G-325A.

USC parent can only file I-130 without the daughter's consent. Rest of the forms have to be filled by the daughter.

To answer the original question... NO. The USC parent can only file the I-130 and wait for approval and PD to become current as daughter does not classify as Immediate Relative. Once I-130 is approved and PD current, the daughter has to apply for AOS by herself if she is in US or go for CP if outside US.

Isn't it what I said in my first response?
And, yes, the answer to the original question is NO, since it was about getting a green card, not just filing a petition (which, again, was mentioned in my first response).
 
My earlier response was an attempt to correct myself as i gave incorrect information regarding G-325A. The aim is to help people by giving as much correct information as possible and I have no intention of proving who is right and who is wrong.
