I would like to request some help on this case , i applied for my wife and my children when i was a permanent resident. In 2001 my wife and two of my children were able to get their green card but one of my children couldn't get her green card because she had already turn 21 years old. The officer that helped us at the time said that she had to wait under the 2b category without filing a new i-130, she was still approved under her mom's application. My question is i recently became a us citizen and would like to upgrade the case but my daughter doesn't have a approval notice on her own, can i upgrade the case with the approval notice that she had with her mom and move my daughter to the 1st category? Or do i have to file a new i-130 so she can obtain an aproval notice? And if the answer is yes, would she be able to retain the priority date that she has?
