I have a question regarding the response time for approval of I-140 in VSC. If the Labour is approved/applied early then their cases will be approved quickly. For example if a person applied for labour in year 1999 apply for I-140 in 2002 wille his case be processed fast by Vermont Center??? I have seen one case recently I-140 was filed in October 2002 and got approved in December 2002.

Can people justify this?? What could be the reason for it to be processed fast?? It is in EB3 Category. I have seen in the Message Board people waiting from March 2002 or January 2002 applied for I-140 and waiting for the approval??

Can people answer my question or share information regarding this aspect??

I always thought there's a seperate line for true concurrent filers. But you get a point, maybe they sort cases by labor day.

Hello wonderfulboy,

I used an existing labor (approved 1999) and filed for I-140 (with CP option) in June 2002. (ND - 06/21/2002). I am still waiting for I-140 approval.

So, am not sure how INS approves case

Nobody knows how INS works my case was filed in April still waiting and there feb cases that are not yet approved but there also sept. cases that are approved. Anything can happen with INS

What is Priority Date? What role does it play in GC Processing? Does it Speed up GC Processing of an applicant??

Priority date is assigned to a Labor Certification when it's filed. It only becomes relevant after I-140 gets approved - you cannot apply for AOS until you date becomes "current". Those dates are published monthly in a Visa Bulletin . At the moment all employment categories are current, which means that I-485 can be filed immediately.

In this sense PD doesn't speed things up or slows them down - it just is - everyone gets it.

As far as your original question - nobody knows, it's a mystery... ;=) [sigh] those things vary greatly depending on.. god knows.
Official "processing" date for EB-* I-140 at VSC it 6/5/2002... if your case was filed before that, you - or your lawyer - can call and bug IIOs about it.
Good luck, buddy

PS Not a lawyer, so not a legal advice

Can any one suggest under new processing times given by VSC which category EB-2 and EB-3 fall in (E31,E32....)???

Somebody mentioned: For TRUE concurrent filers, they need to approve EAD within certain amount of time. But EAD can not be approved without I-140, so they get it done on the side.

Hope they throw in 485 for convenience as well, just that we haven't heard the update due to FBI delay. Hope your guys are no Irania, Iraqia, Pakistani(?), North Korean ...
