The 245(i) can be applied for, at anytime during the 485 process, AS LONG AS the applicant has applied for LABOR CERT or I-140 by April 30th, 2001.
In other words, the April 30th, 2001 cut-off date is for applying for Labor Cert or I-140 (for those who do not need Labor), not for applying for the 245(i) itself.
However, Dallas, I agree with wfegtj on the first part of his/her statement - if you are sure that you have been out-of-status, then you should apply for the 245(i) as early as possible (during the 485 process) so that you can save on processing time later on.
FYI, the 245(i) is applied for by filling in a supplement to the 485 form, called 485 Supplement A and paying $ 1000 in addition. Please consult your immigration lawyer for exact details.
