Dad's i485 Stuck

Hello Friends,

I'd appreciate any insight on my Dad's i485 situation:

Applied GC for Mom and Dad together - RD July 11, 06
Finger Printing completed for both - Begining of August, 2006
Case Transfered to California (Laguna Neigel) Sept 24, 2006
I130 approved for both - Oct 5, 2006
I485 approved for Mom - Oct 10, 2006
GC received (no interview) for Mom - Oct 15, 2006


Still no news on my dad's I485. No RFE either. We went to the local Newark Office in Jan 2007. They said case is pending for approval. No more info was available. I asked them if it was stuck in name check and they said that that was not the case.

Once the case was outside of the processing time, I filed an inquiry on Jan 9, 2007. They said it takes 45 days to get a response. It has been more that 45 days now and no response yet on the inquiry. I called USCIS and they said I have to wait another 30 days (after the 45 days) before I can file another inquiry. It's very frustrating since my mom's case was approved 5 months ago and this case is outside of the regular processing time now.

The only difference in my dad's case is that he had tested positive for one of the medical tests. The physician asked us to get the treatment completed, which we did. The medical papers that went to USICIS with the application included the original positive results for the test as well as the doctor's note that the treatment was completed as required. Could this be the reason for the delay ???

I'd appreciate any thoughts or insights.

Totally same story here.

Same time frame, same story. I think my parent's file is behind a computer desk somewhere and will be found when the computer will be replaced or so. This whole story sucks big time. I have had 2 infopasses and done 2 inquires and sent 2 letters one to MSC and one to Laguna Niguel. Name check has cleared since last December. The USCIS web site says the case is in MSC while at the Infopasses twice I was told it is transfered at Laguna Niguel since in December. I never got any NOF in regard to this transfer and no e-mail as well. One parent has the GC, one no. They keep planing to travel in Europe month after month but they can't do a thing. Their life and mine is on hold because of the giagantic confusion the USCIS is in. I'm loosing patience. I can understand it if the name check did not clear, but this is un******belivable and retarded.
 
Hey thanks for the reply and I can feel the pain. We actually received a response today by mail. It says,

"Our records indicate that your fingerprints have been rejected;therefore, the case is awaiting for a new notice to be mailed. Please allow 30 days before submitting additional inquiries. Thanks You"

I can't imagine that all this time the case was waiting for the fingerprinting notice to be sent out. I am guessing that after receiving the query, they probably pulled out the case from behind the same computer desk where your parent's case is sitting and tried to approve it but can't because fingerprints are now more than 6 months old. So they will send out a new notice for fingerprints. Any thoughts ???

BTW - how did you find out that the name check was cleared in december ? And what was the response you received (if any) to the letters you submitted to MSC and Laguna Niguel ?

I agree this whole thing is retarted !

I foud it out during the first infopass in January. I doublechecked again at this week's infopass. I was told that in the begining of December they received the FBI Name Check Clearance and shortly after they sent the case in Laguna Nigel, CA. As per FBI Finger Print Clearance, they had received it within 24 hours back in August. I am worried though that I never received any notice of transfer from MSC unlike with my other parent's case when they sent me a notice of transfer for I-130 and to my parent one notice of transfer of I-485. At the same time, I received e-mails for the transfer before I got the paper notice. I have not received any response yet. I am turning grey waiting for any kind of response. I do not understand how do they work. They definetly do not use the FIFO system that they claim to do or follow any of their own rules.

God help us and god bless USCIS (Because we so much need the help and they definitly need the blessing...) :rolleyes:
 
Just...

...got an e-mail that my parent's applications were sent today in CSC. Sounds like they input in their computer that they sent it out in December, but in realty the envelope was forgoten under something in the mail room.
It sucks big time. It seems that my letters woke somebody up to check the mail room.:rolleyes:
 
Similar situation

I am also in a similar situation, my mothers GC approved in less than 2 months but father recieved 2nd FP notice immediately but no approval so far. Even his I-130 is pending. What do you guys think, is he stuck in namecheck? Also what is the 1-800 numeber to call? My parents want to travel on AP, is it adviceable, I am planning to file for AP next week?

what is the procedure to initiate the inquiry? Does it have to be made after waiting for 180 days?
 
Yes, it has to be after 180 days. Just call 800-375-5283 and tell them you need to file an inquiry into the case. Make sure they give you a reference or a confirmation number.
