cursory Review before EAD.

Hi All,
As we all know that our learned friends in VSC does a cursory review of i-140 application before approving EAD.

I had been worried about my I-140/I-485 applications as it is a labor substitution and person whose labor I am using is a 4 yrs degree holder and I have 3 yrs degree and fe diplomas, My attroney did a fresh Education eval. before sending all documents to INS,USCIS,whatever is that, this education eval. clearly says that my qaulifications are equal to a 4 yrs US degree, but as I have been seeing on this forum and learning from others,looks like our friends out there in VSC are not accepting education eval and want the person to have 1 single 4 yrs degree from single institute.Thats what I am not vary positive about my approval,anyways.

on Dec 24th of last year they approved my EAD,as far as i knew at that point of time,cursory review before issuing EAD just make sure that we have mentioned same name and job desc on I-140 and EAD application,so I called my attorney and asked him

that what exactly this cursory review means,and this is what he told me.

"They check personal information,job description,salary requirment,education and expereince requirment before issuing EAD,if they feel that one of these criteria is not meeting then they would not issue EAD"

This information I got from him was bit different then what I knew about this situtation.

When I asked him about VSC not accepting education eval. thats stats that candidate has 4 yrs equal against the original person having 4 yrs degree,he said.

"I can not guarentee anything on this but in normal situtation,this is not the case,VSC or any other service center is accepting these education eval,I got approvals for such cases in recent past."

god,I was confused now,I know he is a good attorney and he would nto bulshit about these issues but I WOULD REQUEST ALL YOU FRIENDS TO BE BIT KIND TO ME AND POST YOUR OPENION ABOUT THIS,WOULD BE REAL HELPFULL TO ME.

I am not sure where yo got the information about VSC (or any USCIS centers) not accepting educational evaluation.

The point in case is that when using labior substitution you should try to match the job desc and qualification 'verbatim'. In cases where it is not possible an 'independent' evaluation should be performed. The list of 'independent' evaluators is available in the USCIS website. Your lawyer seems to be a fair guy and the information he quotes are correct.

There is no official release from USCIS about NOT accepting edu evals. So you are in the same boat as any beneficiary of the GC process.
