I am working in USA since Nov 1998 under H1 visa and I changed two employers during this course. Somehow my GC process was a big mess and it did not go through.
About 2 years agio when I switched my company the request was made for 3 years of H1B approval and I actually got the approval for unril 03/2006. But my 6 year limit is expired on Nov 2004. I spent about 4-5 months out of the contry during my 6 years stay under H1.
My immigration to canada was approved so I made a trip to canada on Feb 2005 and applied for H1B stamp there. They approved my VISA and I came back to USA under this new Visa with I94 validity date until 03/2006. I have got couple of questiosn with regard to my situation:
1. What is my status ? AM I in trouble or I am OK ?
2. another company wanst to start a PERM process on me but I am nor working for them. Do you think it might create some problem ?
3. I want to go out of USA and stay in Canada until my H1B is reset again. How long should I stay in Canada ? What would be the criteria and the proof that I stayed out of USA for the time period requied so that I could show them that when they inquire about it.
