Here's my latest update and I'm worried:

Application Type: I485, APPLICATION TO REGISTER PERMANENT RESIDENCE OR TO ADJUST STATUS

Current Status: Notice returned as undeliverable.

On October 31, 2007, the post office returned our last written notice on this case as undeliverable. This can have serious effects on the processing of this case. Please call 1-800-375-5283 to update the mailing address so this notice can be re-sent.

Any suggestions on what to do? I went to infopass today and the agent advised me to write to National Benefit Center as my file is with them. Did anyone have similar experience?
 
No, but you need to call them immeciately and rectify the situation. Did you in fact move? If so, forward your mail from the old address to the new address! Also, file a form with USCIS to give them your new address

I just called them and the service rep has put in a service request asking them to re-send the letter to my new address. The strange thing is I updated my address on 9/7/07 and the uscis letter was returned on 10/31 (or at least the returned letter reached uscis on 10/31). I don't know how long the post office held on to the letter before returning it. I hope to receive the letter soon and find out what it is. I'm not too hopeful on an approval as typically we get an online status update stating the same.

Call TSC IIO and confirm what the document was?

I am pretty sure that this returned mail was a finger print notice. Were you expecting one?

We made address change in 2005, but in 2007, my wife got the same message about the mail undelivered. In a few days, my wife received the postal returned envelop (which was addressed to our old address) within another DHS envelop with latest address...I was shocked to see such a process....It would have been much easier, if they had updated the address in all their system, woudn't it?

I believe the ASC which issues FP notices address database is not updated when we file AR-11 forms. Its my guess....

Best way is to call using POJ method...search for POJ method to call TSC IIO.

If your PD is current, then you may never know.
We have seen people receiving approvals without any email.
On the other hand, it could be anything like FP or SR Response or RFE.
This happened with our FP notice as well despite of doing COA.
The USCIS COA system is screwed up. Once an IO told me that
the FP notice may come from local office and they may still have the
old address !! :D:mad::eek:

I'm from India (EB3)...PD is not current. I did FP in May this year. But, as you said, if their data about FP is not consistent between different service centers then I could have received another FP notice. I'll wait and watch. Thanks for the info...very helpful.
 
is it with NBC?

Just saw your signature again. Your dates and events are quite similar to mine :) So is your case at NBC now?
Any idea why it may have got transferred to NBC?
I have read that some cases transferred to NBC may get interview calls.
Do you have any peculiarity of any legal stay issues or AC21 etc.?
So that is another thing you might want to check.
May be it could be a interview appointment notice.

OK eye140485;1813336, Here me out loud and clear!.
If you have an attorney on your case and you have signed G-28 form (or changed attorney) in any case, Aks your attorney to talk to customer service and resend the notice to him. Trust me that is the BEST way. I was in same situation, RFE was issued on July 19, I called USCIS 20-30 times, made several service request to resend the RFE, Send 7-8 Faxes to USCIS on different Fax number (I got them from the USCIS customer service reps and on from this forum). I mailed 7-8 letters to USCIS stating send me the RFE. Made 3 Infopass found out that RFE became NOID now. The time was clicking and nothing was happening finally I told my lawyer to send the AC21 document as I changed my job and ask for RFE in the that letter as well ...boom it worked and she got the FAX RFE 3 week ago. So again You must talk to your Lawyer to work for you. (the same thing was told to me at the INFOPASS by one of the IO that I should work with my Lawyer on this) To my understanding it is highly unlikely that they will send you the RFE. The only thing you will receive from USCIS is that a letter stating about your case status and thats about it. So trust me the RFE will come to Lawyer and ask your lawyer also to initiate the request to resend your RFE.
Just my two cents!!!

Hey gcckar, Sorry for the delayed response. Here is my full story:

  • My wife is the primary applicant on GC
  • She changed jobs twice: Once in 09/2005 and next time in 09/2007.
  • When we submitted address change this September, our cases got transferred. The strange thing is her case was transferred to San Francisco and mine to NBC.

With the above stuff, it looks quite unlikely that I should get RFE on AC21 as I never filed I140 (or does it have no dependency on I140?).

gckajadoo, thanks so much. I'll talk to my lawyer today. As mentioned above, my wife is the primary applicant. But I have changed jobs few times myself. Do you think I need to send AC21?

If your wife changed the Job then she needs to send AC21, since you are the derivative, you don't have to send any AC21 application.
