Current Salary lesser than the one on LC. Is it okay for I-140 and I-485?

Company says that its okay because salary on LC will be the one I will be receiving after I get my GC.

I am applying for I-140 and I-485 pretty soon. The thing that concerns me is that my current salary on pay stubs will be 15% lesser than the one stated on LC:confused:

The LC and I-140 are for a future position. It's ok but I've handled cases where the question has been raised (either through an RFE or at the interview) and it was necessary to explain the situation and applicable law to INS.

Speak to your attorney for further information regarding the letter and law.

Techincally ok.

Technically you should be ok as your LC salary - should be/will be effective only after GC.

However, I was issued and RFE during my I-140 stage to prove that I was getting paid the amount that was mentioned in the LC.
I lucked out b'coz with bonuses and other incentives I had LC amount plus about $10 more for my prior year W2. I simply send a copy of my W2.

Generally, higher salaries do not cause a problem (after all, the salary and requirements listed on the LC are the minimum for the position, right? INS can't have it both ways (although they sometimes try)). The only way a higher salary would cause a problem would be if the disparity was so great that INS questioned whether the two positions were really the same.
