Current Processing Dates - I140

Hi can someone please give me or point me in the direction of where I can find a brief outline on the steps of I-140 processing .... also where can I get an idea of what the current processing dates are ? Does it depend on your Labor PD date ???

I am EB3 - RIR - Non India, China, etc.

I did look around the forum - but found everything very confusing ! .... is there a dummies guide or something !!!!! :confused:

First off,
140 approvals mostly depend on your company finances. If you are one of those lucky guys who is working for a good company (>100 employees), then you should be fine. Also, INS tries to match your qualification with the labour cert ..
Once your company files for 140, your lawyer will get a receipt number from INS (usually in 3-4 weeks). You can then check the status of your case online @ https://egov.immigration.gov/cris/caseStatusSearchDisplay.do;jsessionid=bBo65B-CZ4z_

Thats all there is to know.

What are the actual steps within the I-140 process ... in other words what should I be expecting to follow ???

I guess receipt of the I-140 would be the first step .... then .... ????

I've seen LUD, AD, etc, dates - dunno what these mean but what should I be tracking ????


Also - what are the timeframes for current ? Any idea on how long I-140 processing takes ?

And when can I submit the I-485 application ? I am EB3 - RIR - Non India, China, etc.

LUD = Last Updated Date. Once you get your receipt, you can register your case online and then you will can track LUDs
AD = Approval Date

Currently VSC is the worst in terms of 140 approvals. Its taking anywhere between 3 months to 1 year or more. The dates on the website https://egov.immigration.gov/cris/jsps/Processtimes.jsp?SeviceCenter=Vermont are indicating that you should expect atleast 1 year for 140 approvals.

As far as your 485 is concerned, you can file it once your dates are current. Check the latest visa bulletin. http://travel.state.gov/visa/frvi/bulletin/bulletin_2771.html , search for "Employment Based" table and the row of your concern is the 3rd one. Currently INS is accepting 485 apps from people whose labour Priority date (PD) is before 01JAN 2000. If you are one of those lucky guys, you can file for 485. If not, you have to wait and hope the dates move forward. Meaning you cannot file for 485, EAD (work authorization) and Advance Parole if your PD is before Jan 1st 2000.
